Terms of Service - Book Your Coach

These Terms of Service define the conditions of access and use of the Book Your Coach platform, accessible via mobile app and website.

1. Purpose

The platform enables the connection between players looking to book sports coaching sessions and independent coaches offering their services. Use of the platform implies full acceptance of these Terms of Service.

3. Nature of the Platform

Book Your Coach is a matchmaking platform between players and coaches. The platform does not intervene in coach selection, session organization, pricing, payment methods, or service delivery. The platform only records a booking between a player and a coach. Service delivery and session organization are exclusively the responsibility of the coach and the player. The contractual relationship regarding coaching sessions is concluded directly between the player and the coach.

4. Platform Access

Access to the platform is reserved for adults with legal capacity to contract. Minors are not authorized to use the platform. Users agree to provide accurate information when creating their account.

5. Account Creation

Two types of accounts can be created on the platform: Player account: allows searching for coaches, viewing profiles, booking sessions, and publishing a review after a completed session. Coach account: allows creating a professional profile, offering coaching services, setting availability, setting rates, and specifying accepted payment methods. Coaches using the platform agree to comply with the Coach Charter, available on the platform. Creating a coach account and subscribing implies acceptance of this charter. Non-compliance with the Coach Charter may result in account suspension or deletion. Each user is responsible for the confidentiality of their credentials.

6. Coach Profile Content

Coaches are solely responsible for information published on their profile, including their bio, qualifications, degrees, experience, rates, and description of services offered. Coaches agree to publish accurate, honest, and up-to-date information. Book Your Coach does not guarantee the accuracy of information published by coaches and does not systematically verify these elements. Book Your Coach reserves the right to remove or modify any content that does not comply with these Terms of Service.

7. Coach Obligations

Coaches offering services through the platform declare that they are legally authorized to practice their activity, hold the necessary degrees and qualifications, comply with applicable sports teaching legislation, and have the necessary professional insurance. Book Your Coach does not systematically verify these elements. Coaches are solely responsible for the compliance of their activity. Book Your Coach may however request information or supporting documents related to the coach's activity at any time, without this constituting an obligation to monitor.

8. Session Booking

Players can book a session by selecting a slot offered by a coach. The platform records a booking between a player and a coach. However, the coach retains the ability to refuse or cancel a booking in case of unavailability or scheduling error.

9. Service Payment

Book Your Coach does not intervene in payments. Payments are made directly between the player and the coach according to the terms defined by the coach. Each coach freely determines their rates, accepted payment methods, and payment conditions. When online payment is required, it must be made at the time of booking. When online payment is not required, payment can be made directly to the coach at the start of the session. In the case of a session package purchased from the coach, a session may be deducted from the package at the time of booking. Book Your Coach does not collect any payment and does not intervene in financial transactions.

10. Session Cancellation

Bookings can be cancelled up to 24 hours before the scheduled session time. In case of late cancellation (less than 24 hours before the session), the applicable conditions are those defined directly between the coach and the player. Book Your Coach does not intervene in the management of cancellation-related disputes.

11. Reviews and Ratings

After a session booked through the platform, the player can leave a rating and a comment. Reviews must be objective and respectful. Book Your Coach reserves the right to remove any review that is insulting, defamatory, fraudulent, or unrelated to the service.

12. Sports Practice Liability

Sessions offered through the platform involve physical sports activity that may carry risks. Users acknowledge practicing these activities at their own risk. Each player is responsible for their health condition and physical ability to practice the activity. Coaches are responsible for session supervision. Book Your Coach cannot be held liable for accidents, injuries, or damages occurring during sessions.

13. User Conduct

Users agree to behave respectfully. It is notably prohibited to engage in insulting or aggressive behavior, harass another user, publish fraudulent content, or use the platform for illegal purposes. In case of non-compliance with these Terms of Service, Book Your Coach may suspend or delete a user account without notice.

14. Coach Subscription

Access to features allowing coaches to offer services on the platform may require a subscription. This subscription includes coach profile creation, service listing, availability management, and platform visibility. The subscription rate is the same for all coaches. Book Your Coach may occasionally offer promotional deals, including free trial periods. The subscription provides access and visibility on the platform. Book Your Coach does not guarantee any volume of bookings or clients.

15. Payment and Subscription Cancellation

The subscription is billed on a monthly basis. The subscription is commitment-free and can be cancelled at any time by the coach. Cancellation takes effect at the end of the current subscription period. Amounts already paid are not refundable for the current period.

16. Payment Default

In case of subscription payment default, the coach's profile may be immediately suspended or removed from the platform and their services may become unavailable for booking. The profile can be reactivated after payment regularization.

17. Founding Coach Program

Book Your Coach may offer a specific Founding Coach status for the first coaches registered on the platform. This status may provide access to certain benefits such as a preferential subscription rate, complimentary subscription periods, or featured placement on the platform. Book Your Coach reserves the right to limit the number of coaches benefiting from this status and to modify or end the program.

18. Account Suspension or Deletion

Book Your Coach reserves the right to suspend or delete a user account in case of fraud, false information, abusive behavior, non-compliance with the Terms of Service, illegal activity, or damage to the platform's image. Suspension may occur without notice.

19. Intellectual Property

Elements composing the platform (logo, interface, content, design) are protected by intellectual property laws. Any unauthorized reproduction or use is prohibited.

20. Terms Modification

Book Your Coach may modify these Terms of Service at any time. Users will be notified of changes through the platform.

21. Applicable Law and Jurisdiction

These Terms of Service are governed by French law. Any dispute shall be submitted to the competent courts within the jurisdiction of the registered office of PG Holding.
